AUDIT-AZ’s Election Lawsuit to Continue in Arizona on Monday

Defendants’ tactics are to bury the opposition in paperwork

(25 so far), but the motions are all too familiar. First they attempt to remove Jim March Simpson, John Brakey and Richard Charmin as expert witnesses (despite their previous work and, in particular, Simpson’s previous appearance in the Arizona Courts as an expert witness).

Second,  they claim that John Brakey is not a viable plaintiff as an elector and that political parties or candidates are the only people we can bring a suit of this kind (not so as it’s been done numerous times in past).

Third, they are playing the clock game. Various counties are still claiming that timely service did not take place despite completion of such service and Defendants’ obvious intentional delays and resistance to receiving such service.

Finally, a few complaints state that there should be no legal action about misconduct in the Presidential Primary Election because the outcome would not have been affected by state gaffs/shenanigans.  Kielsky is presenting a two fold response to this argument.  Whether the outcome is affected by misconduct in elections should not be the litmus test for the remedy we seek in this case.  The case, however, will demonstrate that a lawfully executed election would have yielded a different outcome and distribution of delegates.

    REPLY: I would counter that it is at present impossible to know the extent to which the election outcome was affected, because if it WAS affected, the results as we have been told them would not be the same. Since delegates are awarded proportionately, the implications are national, not statewide, and we do not yet know whether Arizona misconduct can be associated with a final delegate shortfall for the Sanders campaign, which seems to be the one most affected by what happened. However, we do know that elections are not only about RESULTS, they are about the confidence of the voters in the peaceful election process. The harm to whomever is ultimately elected is that the election problems in maricopa DELEGITIMIZE THE ELECTION in the eyes of voters. Whoever is elected has to deal with the taint — whether the election involved actual voter suppression, or whether the actions of Helen Purcell created the IMPRESSION of voter suppression. The notion that ANY voter in an election is not harmed when ANY OTHER voter does not get to express their vote and opinion fully is a misinterpretation of democracy. It is as much about participation as it is the quality of outcome that derives from full participation. Thank you to John Brakey et al for your efforts to stand up for the protection of our PROCESS of peaceful transitions in government by free and fair elections. Those who wish to taint, subvert, or manipulate elections are cowards and do not understand the meaning of democracy.

    I am so impressed by your bravery and commitment. I will be sending you some money though I don’t live in AZ and I’m poor. But you are 1 in a million for taking this on!!
    We need the SAME commitment in the remaining 49 states!!

    I can’t believe this doesn’t warrant a federal investigation. Is there no end to the rabbit hole? It doesn’t make sense that we continue knowing full well the entire election process is a scam. The perps need to be tried and convicted of treason so they can hang from a rope. There has never been a more serious issue than this one.

      You can’t trust the Feds. They will cover it up as they had in the past in Arizona.
